POLICE REGULATIONS CHANGE TO CONDITIONS
Following the recent National Negotiating Meeting and in line with the requirement to mirror Police Regulations outlined in the Transport and Safety Act 2003 the following changes to our conditions will be made on a date to be announced. Further changes will be introduced with completion being hopefully April 2007.
- TOIL CALCULATION
Police Regulations calculate overtime in blocks of 15 minutes before it is enhanced. In respect
of casual overtime the first 30 minutes is discounted and only at 45 minutes does the
enhancement at 1 1/3 start.

- COMPENSATORY LEAVE PAYMENTS FOR ANNUAL LEAVE
Police Regulations allows for either leave to be credited or for leave plus payment to be made
if the officer chooses, with the latter being more beneficial i.e.
POLICE REGULATION ANNEX 0 (SECTION 5A)
Where a member of a police force has been recalled to duty from a period of absence from
duty to which this paragraph applies, he/she shall be granted, in compensation for being
recalled to duty on any day during that period which is a day of annual leave or a day taken off
in lieu of overtime:
- If he was so recalled to duty 1 or 2 days (whether or not in the latter case those days
formed a single period), an additional 3 days annual leave (or, if the member so
choose, 1 day’s annual leave and 1 day’s pay at double time) in lieu of each such day
for which he was so recalled; or
- If he was so recalled to duty for 3 or more days (whether or not forming a single
period), 2 day’s annual leave (or, if the member so choose, 1day’s annual leave and
1 day’s pay at double time) in lieu of each of the first 2 such days for which he was so
recalled, and 1˝ days’ annual leave (or, if the member so choose, 1 day’s annual leave
and ˝ day’s pay at double time) in lieu of each such day for which he/she was so
recalled thereafter.
Police Regulations allow to be either credited leave or to be credited leave plus
payment.
- ACTING / TEMPORARY PROMOTION TO INSPECTOR
Acting Inspector is deemed to be a period of less than 2 months and during which there is
no entitlement to the payment of overtime or TOIL. For planned rest day or public holiday
working during the period this will paid at the appropriate enhanced rate at the substantive
Sergeants rate of pay.
Temporary promotion is deemed to be a period of 2 months or more and overtime, TOIL,
rest day or public holiday working is not payable.
TRAINING COURSES PAYMENT OF OVERTIME AND REST DAY
AND PUBLIC HOLIDAY WORKING
Overtime and rest day working is suspended whilst undergoing training courses.
This is current practice.
- REST DAY WORKING CANCELLATION
There are two options when the requirement for rest day working is cancelled and they
are as follows :-
- Where the officer is told with one or more than 7 days notice (and less than 15
days) the rest day will be taken with no compensation.
- Where the officer is given less than 8 days notice the officer can choose between
taking the rest day with no compensation or working the rest day with compensation
in accordance with the regulation.
- WORKING OUT OF REST DAY
Police Regulation 26 Annex H, only duty performed on a rest day attracts the appropriate
enhancement.
As soon as the shift goes into a scheduled duty day then the rate of pay returns to the
appropriate rate i.e. 1 1/3.
A member of a police force of the rank of constable or sergeant shall if required to do duty on
a day which is rostered a rest day, be granted.
- Where he/she receives less than 15 days notice of the requirement an allowance
at the appropriate rest day rate, or
- In any other case another rest day which shall be notified to him/her within
4 days of notification of the requirement.
- Subject to paragraph (2) (a) the appropriate rest day is for each completed 15 minutes of duty on a rostered rest day, the fraction of a day’s pay specified in sub paragraph (C).
- The fraction is:-
- Where the member receives less than 5 days notice of the requirement, one sixteenth and
- in any other case three sixty fourths.
i.e. No payment change.
The above changes include extracts from Police Regulations, as soon as the negotiations are
concluded a comprehensive document will be produced.
